Privacy Policy

This website (the “Website”) is operated by and on behalf of Nitol Solar Limited (the “Company”), a company incorporated in Jersey under registered number 95540 and whose registered office is PO Box 437, 4th Floor, 13 Castle Street, St Helier, Jersey JE4 0ZE. References in this policy (the “Privacy Policy”) to “we” or “us” are references to the Company. References to the Company in this Privacy Policy and in any opt-in request(s) included on the Website, will include Nitol Solar Limited and any Nitol Solar Group Companies (as defined in this Privacy Policy).

We respect your privacy and this Privacy Policy explains our practices, including how we collect personal data, what type of personal data we collect and how we use that personal data. By providing any personal data to us via the Website, you acknowledge that you are giving us your consent to use your personal data in the manner set out in this Privacy Policy.

1. What personal data we collect

In general, you will be able to visit the pages of the Website without having to provide us with any information about yourself. There are, however, circumstances in which we do request personal data from you. There is no obligation on you to provide any such personal data and your decision to do so is entirely voluntary. The personal data collected is as set out in the data request boxes on the relevant sections of the Website, and may include information such as your name, postal address, email address and telephone number. Additional information such as your age and gender may also be collected on an entirely voluntary basis and (unless otherwise indicated) will be collected for demographic purposes only. For the avoidance of doubt, Sensitive information is not sought through the Website except where legally required. Sensitive information includes data relating to: race or ethnic origin; political opinions; religious or other similar beliefs; trade union membership; physical or mental health; sexual life or criminal record. Where you do provide Sensitive information this will be accepted as explicit consent to the Company to use that information in connection with the purpose for which it has been provided.

2. Why we collect personal data

There are a number of reasons why we may wish to collect, store and use your personal data, such as the following:

- to deliver requested materials or information;

- to process any order for goods or services you make and to provide any after-sales services;

- to improve our marketing and promotional efforts and to assist us in improving the content of services offered on the Website;

- to better understand your needs and how we can improve our products and services for you;

- to conduct competitions, free prize draws and other promotional offers;
 
- to conduct product surveys;

- to consider employing you if you have provided personal data pursuant to a job application;
 
- to provide you with information about our latest products, services or offers (subject to you having opted-in to receive such information (see section 10 below)).

3. Anonymous Information

We may also automatically collect technical information from which you cannot be identified when you connect to the Website. An example is the domain name of the website from which you linked to the Website. We collect this information to help us with identifying the Website user’s browsing preferences. The information is used for internal purposes only so that we can carry out research on the Website user’s demographics, behaviour and interests. Anonymous or generic information from which you cannot be personally identified is not personal data and is therefore excluded from the provisions of this Privacy Policy.

4. Transfer of personal data to the Nitol Solar Group Companies

Please be aware that we may share, make available or transmit personal data collected from you to other Nitol Solar Group Companies both within the European Union and worldwide. Where we transfer personal data outside the European Union, we will only do so in accordance with European data privacy laws. “Nitol Solar Group Companies” in this context means Nitol Solar Ltd, the Jersey parent company of the Nitol Solar group of companies, and any other company or entity the majority of whose shares or equity is owned or controlled directly or indirectly by Nitol Solar Ltd.

By providing any personal data to us you acknowledge that you are giving us your consent to transfer it to any Nitol Solar Group Companies worldwide.

5. Disclosure of personal data outside the Nitol Solar Group Companies

We will not disclose your personal data to third parties other than Nitol Solar Group Companies, without your consent, except in the following circumstances:

- where the personal data is required to be disclosed to sub-contracting third parties or our professional advisers to enable performance of any contract you have entered into or to enable fulfillment of any competitions, free prize draws or other promotions you have entered or made a claim in respect of. Such sub-contracted activities may include fulfilling orders, processing credit card payments, delivering packages or otherwise sending postal mail or emails, providing marketing assistance and customer services;

- where, in accordance with European data privacy laws, the personal data disclosure is necessary in order to pursue our legitimate interests; or

- where the personal data is required to be disclosed by law or if a government or law enforcement agency requests such disclosure.

If personal data is disclosed to third parties to enable them to provide services on behalf of, or at the direction of any Nitol Solar Group Companies, then we try to ensure that the third parties comply with the terms of this Privacy Policy and with all applicable legislation.

However, if at any time in the future we sell our business to a third party, we may pass your personal data to the business purchaser in order that it can continue to carry on the business. Any business purchaser would be required to comply with relevant data privacy laws.

6. Security of collected personal data

We use all reasonable efforts to protect your personal data and to keep it secure and protected from unauthorised access, use, alteration or unlawful destruction.

We limit access to your personal data so that only those employees who need access to your personal data for the purposes set out in section 2 above will be given such access.

7. Cookies

When you visit the Website, it may send a session cookie to your computer. A cookie is a small piece of data which is placed on the hard drive of your computer when you access the Website. The use of cookies will help us to understand which sections of the Website are the most popular by allowing us to see which pages visitors are accessing and how much time they are spending on them. By studying these traffic patterns we are better able to adapt the Website to suit customer demand and provide you with a more customised user experience. Cookies will also recognise users who have previously visited the Website, so that the next time the user accesses the Website, the information in the cookie is sent back to the user so that the information displayed can vary depending upon the user’s preferences. 8. Accuracy of information

Access to your personal data

The Company is not responsible for keeping an accurate record of personal data once you have submitted the information.

You may contact us at the email address set out in section 12 below if you would like to view, amend or update the personal data which we have collected from you and store on our servers or if you would like us to delete your personal data. We will not hold your personal data for longer than is reasonably necessary for the purposes set out in this Privacy Policy.

We reserve the right to charge you a small administrative fee (not exceeding £10) in relation to requests to provide a copy of personal data we hold about you.

9. Minors

We encourage all parents to instruct their children in the safe and responsible use of their personal data whilst using the Internet. In addition, we do not knowingly solicit personal data from minors or send them requests for personal data.

10. Direct Marketing

We will only use the personal data we collect from you through the Website for direct marketing purposes where you have given us your consent to do so. If you are registering your details you will usually be asked if you would like the Company to send you information by email, by SMS or MMS message and/or by post about our latest products, services, promotions and other offers. Consent is usually indicated by ticking an “opt-in” box although on some occasions we may rely on the “soft” opt-ins permitted by law. The opt-in boxes may or may not be split between different classes of information or different means of sending the information to you.

If you have subscribed to receive direct marketing from us, but wish to unsubscribe then you should send an email to that effect to info@nitolsolar.com.

We may change this Privacy Policy at any time with or without notice. Please check this Privacy Policy periodically to inform yourself of any changes. Your continued use of the Website after any change to this Privacy Policy will be considered acceptance of those changes by you.
